Gary Oldman has not yet been presented with or signed a contract to appear in Harry Potter and the Order of the Phoenix, HPANA has confirmed.
Despite a recent statement from the studio, we have learned and double-confirmed that no agreement has been made.
"At this time Gary Oldman is not set to appear in the next Potter film," manager Doug Urbanski told HPANA. "I cannot explain why the studio confirmed his appearance."
It's unlikely Oldman wouldn't reprise his role as Sirius Black in the fifth film.
Note: This does not imply he won't be in the movie, just that there's no current definitive agreement for him to appear.

He must to come back just for the simple fact that he is a key character that has already established himself in harrys' life not only on the movie screen but also in the eyes of the public. Plus, he is a very talented actor and his loss would bring down the overall mood of the movies.

i was so mad that Gary barely had a part in Goblet of Fire. I really love him and was so happy that he was cast as Sirius. So i really, really, hope he gets into OotP!!! He's such an amazing actor and i can't imagine anyone else playing Sirius' part.

Wait, I've read on another site (Dissendium -in the news archive) that David Heyman declared officially to Reuters that he definitely wants Gary Oldman back to play Sirius in OotP!!!! Here's the exact quote:
"We're not shooting his part for quite a while, and as is always the case, you begin with the parts that are most pressing. We have every intention of having Gary Oldman play Sirius Black."
