Roger Rapoport of Michigan-based RDR Books said he expects attorneys will file an appeal
to preserve their right to continue battling a lawsuit from JK Rowling and Warner Bros. preventing them from publishing an unofficial Harry Potter encyclopedia, according to the Detroit Free Press:
In a 60-page opinion, [U.S. district judge Robert] Patterson said the work quotes too directly from the Potter books and dwells too much on a pair of books written by Rowling to explain aspects of the wizarding world she created.
Rapoport and Vander Ark are considering whether they could edit the book to pass the judge's muster.
Naturally, we'll keep everyone posted as more details emerge.
UPDATE: Thanks to Harry Potter Prognosticators for letting us know they've posted an exclusive interview with Steve Vander Ark
on their podcast.

For gosh sakes, just drop it, Lexicon! If Rapoport and Vander Ark truly love the Harry Potter series like they claim they do, then leave JKR and her creations alone!
Have some respect for Ms. Rowling's publication rights and stop trying to make money off of her ideas!

Lexicon is not using anyones ideas, But his own...The laws says you can not patient or copyright an Idea. It is Warner Bros. That started the suit and encouraged JKR to go and fight. She sold 3/4 of her rights to WB. Now, It is upto the Lawyers to make their earnings on this one with an Appeal.

Pretty sad if they continue with this. They just don't have a leg to stand on. Should have consulted other attorneys before writing the book.

Well that was interesting. I hope they don't get an appeal though. It's JK's work and her work alone. I don't know why people are making such a big deal about it.

It was good as a website, but writing the book was going too far. We won't get anything new from reading the lexicon anyway; it's just basically Jo's work regurgitated. I hope it doesn't get appealed.
I can't wait for J.K.'s real one!

Yes, I think they should appeal the decision, and if it goes back to court, WB should keep it's 'abnormally large nose' out of it.
This could have been settled to the bennefit of both parties involved. I don't think JKR would have gone this far if WB wasn't pushing her from behind. I still smell a RAT.
Blessings! Hecate3fold!

Sorry for the double post but I hadn't read the posts before I wrote mine.
JAYSTARR, Is it true that she sold seventy five percent of her rights to WB? If so that explains everything. Please tell me where you heard this, I'd like to read more about it.
Blessings! Hecate3fold!

Thanks to this... Jo might really wait ten years before her encyclopedia is published. This is not fair to her. They should leave this woman alone and move on. They didn't win the first time, forget it. Steve did not put any of his own work in that book. It is all Jo's work. He is basically taking his website and putting it in this book and calling it "his." Why can't some people not understand that!?

Well, I'm in the camp where I think that Steve Vander Ark is in the WRONG.
It's not his creation.
He has not contributed any new angle or insight.
It's just taking someone else's blood, sweat and tears and making money from it.
I agree with the judge's decision.

Even if they do manage to get it published most TRUE HP fans wouldn't buy it anyway--it would be taking money from Jo's pocket. And, although she does make loads of money, that is no excuse to steal from her and I know I'm not a thief...

I never understood this. All of the work belongs to JO. It is her baby, she should be the only person allowed to write the encyclopedia. I'm dying for something new, but I wouldn't buy it if it wasn't written by her! Only she KNOWS the back stories, we can only guess!
